Immediate Relatives of U.S. Citizens

Persons who qualify as immediate relatives of U.S. citizens are highly preferred candidates for immigration. Immediate relatives of a U.S. citizen can immigrate to the United States without being subject to any numerical restrictions, unlike other close family members of U.S. citizens or permanent residents. The following aliens can qualify as immediate relatives of U.S. citizens:
  • Spouses of U.S. citizens
  • Children of U.S. citizens (provided child is unmarried and under the age of 21 years), and
  • Parents of U.S. citizens (provided citizen is 21 years of age or older)
  • First : A category of family immigration (F1) for unmarried sons and daughters of American citizens.
  • Second : A category of family immigration (F2) for spouses, children and unmarried sons and daughters of lawful permanent residents.

    • Unmarried Sons and Daughters (21 years of age or older)
  • Third : A category of family immigration (F3) for married sons and daughters of American citizens and their spouses and children. Before 1992 this was known as fourth preference (P-4).
  • Fourth : A category of family immigration (F4) for brothers and sisters of American citizens and their spouses and children. The American citizen must be 21 years of age or older before he/she can file the petition. Before 1992 this was known as fifth preference (P-5).
