I have a previously approved I-140 petition, can I retain my priority date for a new or subsequent I-140 petition?
Yes. If you have a previously approved EB-1, EB-2, or EB-3 I-140 petition, you can retain the oldest available priority date for a new or subsequently filed and approved EB-1, EB-2 or EB-3 I-140 petition.
I am on an L-1A, do I have to file a PERM labor application for purposes of a Green Card application?
No, someone on an L-1A is exempt from filing the PERM labor application and can instead file an I-140 petition with the USCIS.
